RESOLUTION NO. 812, OF MARCH 23, 2020

Defines procedures to be adopted by the agents regulated by the ANP, while the temporary measures to deal with the public health emergency of international importance resulting from the Coronavirus (Covid-19) established by the States and Municipalities of the Federation last. THE DIRECTORATE OF THE NATIONAL AGENCY FOR PETROLEUM, NATURAL GAS AND BIOFUELS - ANP, in the exercise of the powers conferred by art. 6th of the Internal Regulation and by art. 7 of Annex I of Decree No. 2,455, of January 14, 1998, in view of the provisions of Law No. 9,478, of August 6, 1997 and in art. 45. of Law 9.784, of January 20, 1999, considering the emergency health situation of public calamity due to the Coronavirus (Covid-19), as well as the need to adopt precautionary measures, based on Process no. 48610.204677 / 2020-15 and in Board Resolution No. 149, of March 23, 2020, resolves:

CHAPTER I PRELIMINARY PROVISIONS Art. 1 The procedures to be adopted by ANP regulated agents are defined while the measures established by the States and Municipalities of the Federation last to reduce the risk of spreading the Coronavirus (Covid-19), including regarding the suspension of administrative procedural deadlines.

CHAPTER II GUIDELINES AND PROCEDURES Art. 2 The representatives of the operators of oil terminals and pipelines, their derivatives and biofuels and natural gas transporters must inform, by email incidents.movimentacao@anp.gov.br, of any changes in the operational routines that may compromise totally or partially the national supply of oil, its derivatives, natural gas and biofuels, accompanied by the respective action plans with a view to the continuity of the provision of services and, consequently, the national supply. Art. 3 The representatives of the liquid fuel distribution, liquefied petroleum gas (LPG) distribution agents, of automotive fuel retail outlets and those of LPG resellers must inform, by email, incidentes.abastecimento@anp.gov .br, any changes in the operational routines that may compromise totally or partially the national supply of oil, its derivatives, natural gas and biofuels, accompanied by the respective action plans with a view to continuing the provision of services and, consequently, national supply. Art. 4 As long as the public health emergency of international importance resulting from the Coronavirus (Covid-19) lasts, the ANP will not carry out the surveys that deal with: I - ANP Resolution No. 52, of December 2, 2015, in its art. 21; II - ANP Resolution No. 734, of June 28, 2018, in its art. 9, art. 14, item I, and art. 24, item VI. § 1 The granting of the operation authorization referred to in art. 7, items I and II, and the approval referred to in art. 14, item I, and art. 24, item VI, are subject to the approval by the ANP of the documentation contained in art. 9, paragraph 1, of ANP Resolution No. 734, of June 28, 2018, and of the photographic report to be requested by letter. § 2º The cases of inspection provided, listed in art. 9, items I, II and III, and art. 14, items II and III of ANP Resolution No. 734, of June 28, 2018, will have their inspection waived. § 3 After the end of the emergency referred to in the caput, at the discretion of the ANP, the inspection of the facilities that have obtained a grant during this period will be prioritized, without conducting an inspection. § 4 The ANP's Inspection Manual is available on the website of the ANP, with guidance on the requirements to be verified in the documentation mentioned in § 1. Art. 5 Automotive fuel retailers should operate, at least, from Monday to Saturday, from 7:00 am to 7:00 pm, based on art. 22, item XI, of ANP Resolution 41, of November 5, 2013. Single paragraph. Any operation at a time lower than that indicated in the caput must be requested by the agent and previously authorized by the ANP. Art. 6 The application of § 3, of art. 13, of ANP Resolution No. 784, of April 26, 2019, to space assignment contracts on storage and road loading bases. Art. 7 ° The liquid fuel distributors and the aviation fuel distributors will be exempted from the fulfillment of the obligations imposed by ANP Resolution no. 45, of November 22, 2013, and by ANP Resolution no. 6, of January 19, 2015 , respectively, while the public health emergency of international importance resulting from the coronavirus lasts (Covid - 19). Art. 8 The regulated agents are responsible for the supply of fuels, in such a way that any acts that cause damage to the supply will be subject to penalties by the ANP. Art. 9 In view of the current emergency situation, based on its general power of caution, in order to protect the national fuel supply, the ANP may change the measures provided for in this standard at any time, as well as adopt others that necessary, exceptionally dispensing with public consultation and audience. Art. 10. The procedural deadlines for ANP notifications and administrative sanctioning processes are suspended until April 30, 2020, as long as they do not require urgent processing.
